Our expertise

We have particular expertise in the following three areas.

Public works projects

We are experts on the public works contract, having advised on all iterations of the contract since the first release in 2007.

We have been involved in countless public works projects, across both civil-engineering and building contexts. We have helped secure some of the largest recommendations ever made in contractors' favours at conciliation.

Enda O'Keeffe has written articles and handbooks on the public works contract, and has spoken at conferences on the topic, for more than 15 years. He has provided training on the use of the contract to public bodies and contractors.

Adjudication

We have been involved in more than 30 adjudications, including one of the most important High Court decisions on the topic to date. We have helped clients adjudicate payment disputes for values between €400k and €32m.

We have on a number of occasions designed and executed commercial strategies involving multiple rounds of adjudication on the same project, to help close wide gaps between competing final-account valuations.

We are typically engaged to support referring parties, but we also help main contractors defend payment disputes.

PPP projects

Enda O'Keeffe performed a liaison role on the authority side of a major PPP motorway project while practising as an engineer. He understands PPP contracts from the site up.

We have assisted contractors to negotiate the works contracts, the interface agreement, and all associated documents, on three recent Irish PPP projects.

We have also helped contractors resolve disputes on roads, social-housing and healthcare PPPs, working co-operatively with the project co's and sponsors in all cases.
